Welcome to the official website of Medifalcon Diagnostics (A Unit of Medifalcon India Pvt. Ltd.) ("Medifalcon Diagnostics", "Company", "we", "us", or "our"). Your continued access to and use of this website and/or mobile application constitutes your acceptance of and agreement to comply with the Terms and Conditions set forth below.
These Terms and Conditions govern your relationship with Medifalcon Diagnostics in connection with the use of this Website/App and all diagnostic, healthcare, laboratory, wellness, home sample collection, and other related services made available through our Website/App.
These Terms and Conditions apply to all services provided through the official Website/App of Medifalcon Diagnostics, including but not limited to online test bookings, health packages, home sample collection services, appointment scheduling, report delivery, customer support, online payments, health information services, and any other digital services offered by the Company (collectively referred to as the "Services").
This Agreement establishes the terms governing the access to and use of the official website of Medifalcon Diagnostics, including all associated webpages, mobile applications, digital platforms, and online services operated by the Company. By accessing, browsing, registering on, or using the Website/App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions.
Key Definitions for Users:
"You," "Your," "User," or "Customer" refers to any individual, patient, caregiver, organization, or entity accessing or using the Website/App or availing any Services provided by Medifalcon Diagnostics.
"We," "Us," "Our," or the "Company" refers to Medifalcon Diagnostics (A Unit of Medifalcon India Pvt. Ltd.), including its directors, officers, employees, laboratories, collection centres, affiliates, subsidiaries, authorized franchisees, representatives, service providers, and business partners.
By accessing, registering on, or using the Website/App and its Services, you agree to be legally bound by these Terms and Conditions, together with all applicable policies, guidelines, privacy notices, disclaimers, refund and cancellation policies, and any additional terms that may be published by Medifalcon Diagnostics from time to time (collectively referred to as the "Terms of Use").
Notice: Medifalcon Diagnostics reserves the right to modify, amend, update, or revise these Terms of Use at any time without prior notice. Any changes shall become effective immediately upon publication on the Website/App.
11. DEFINITIONS AND INTERPRETATIONS
The following terms shall have the meanings assigned to them below unless the context otherwise requires:
22. ELIGIBILITY & CONFIDENTIALITY
To access or use the Website/App or any Services offered by Medifalcon Diagnostics, you must be at least 18 (Eighteen) years of age, or have attained the legal age required to enter into a binding contract under applicable laws.
If you are under the age of 18 years, the Website/App and Services may only be accessed or used through a parent, legal guardian, or authorized representative who accepts these Terms and Conditions on your behalf.
Confidential Information Protection
"Confidential Information" includes login credentials, passwords, medical records, laboratory reports, personal information, payment information, business processes, technical data, and pricing information.
Both the User and the Company agree to maintain the confidentiality of such information and shall not disclose it to any third party except where required by law, statutory order, prior written consent, or as necessary for healthcare service delivery.
33. DIAGNOSTIC SERVICES
Medifalcon Diagnostics provides diagnostic laboratory testing, pathology services, preventive health check-up packages, home sample collection, corporate health screening, online appointment booking, and digital laboratory reports.
The Services are intended solely for the individual Customer who has booked them and are generally non-transferable, unless permitted by applicable law or expressly authorized by Medifalcon Diagnostics.
Before booking or undergoing any diagnostic test, Users must carefully review all preparation guidelines, fasting requirements, and precautions provided by the Company.
44. RESTRICTIONS ON USE
Users shall not use the Website/App for any unlawful, fraudulent, or unauthorized purpose. Without limiting the foregoing, Users shall not:
- 1.Use the Website/App for fraudulent or unauthorized activities.
- 2.Upload or publish defamatory, obscene, deceptive, or unlawful material.
- 3.Copy, reproduce, modify, reverse engineer, or exploit any content.
- 4.Violate any intellectual property rights belonging to Medifalcon Diagnostics.
- 5.Transmit viruses, malware, spyware, or malicious software code.
- 6.Attempt unauthorized access to servers, databases, networks, or accounts.
- 7.Use automated bots, crawlers, scrapers, or extraction technologies.
- 8.Impersonate any person or entity or falsely represent affiliation.
55. REGISTRATION PROCESS
To access certain Services, Users must complete the Registration Process by providing accurate details including Full Name, Date of Birth, Gender, Mobile Number, Email Address, and Sample Collection Address.
Users are solely responsible for maintaining the confidentiality of their account login credentials and for all activities occurring under their Account.
66. PAYMENT
Users agree to pay all applicable fees for Services in accordance with the pricing displayed at the time of booking via Credit/Debit Cards, UPI, Net Banking, Digital Wallets, or authorized payment gateways.
In the event of pricing errors or technical glitches on the Website/App, Medifalcon Diagnostics reserves the right to cancel or modify bookings prior to sample collection, with full refund for successfully received payments.
77. REFUND AND CANCELLATION POLICY
88. DATA CONFIDENTIALITY & PRIVACY
Medifalcon Diagnostics is committed to safeguarding patient data, medical records, diagnostic results, and personal information in accordance with applicable Indian data protection laws and Privacy Policy guidelines.
99. INTELLECTUAL PROPERTY RIGHTS
All content, logos, trademarks, report formats, software, algorithms, databases, scientific protocols, and digital platforms belong exclusively to Medifalcon Diagnostics (A Unit of Medifalcon India Pvt. Ltd.).
1010. ANTI-BRIBERY AND ANTI-CORRUPTION
All Users, Vendors, Business Partners, and Franchisees must strictly comply with the Prevention of Corruption Act, 1988, and Prevention of Money Laundering Act, 2002. Offering or receiving bribes, kickbacks, or improper benefits is strictly prohibited.
11. WAIVER
No delay or failure in exercising any right or remedy shall operate as a waiver of such right under this Agreement.
12. RELATIONSHIP OF THE PARTIES
The relationship between Medifalcon Diagnostics and Users is that of independent contracting parties.
13. SEVERABILITY
If any provision is held invalid or unenforceable, remaining clauses shall continue in full force and effect.
14. ASSIGNMENT
Users may not assign rights under these Terms. Medifalcon Diagnostics reserves the right to assign obligations to affiliates or corporate successors.
15. ENTIRE AGREEMENT
These Terms, along with Privacy Policy and Refund Policy, constitute the complete agreement between the Parties.

1717 & 18. GOVERNING LAW, JURISDICTION & ARBITRATION
Governing Law: Governed and construed exclusively under the laws of the Republic of India.
Exclusive Jurisdiction: Subject to arbitration, the courts having jurisdiction at Dibrugarh, Assam shall have exclusive jurisdiction over all legal proceedings.
Arbitration: Unresolved disputes shall be referred to a Sole Arbitrator under the Arbitration and Conciliation Act, 1996. Seat and venue of arbitration shall be Dibrugarh, Assam, India.
19. AMENDMENTS
Medifalcon Diagnostics reserves the right to revise these Terms at any time with immediate effect upon website publication.
20. ELECTRONIC ACCEPTANCE & PUBLIC STATEMENTS
Constitutes an electronic record under Information Technology Act, 2000. Continued use constitutes valid legal binding acceptance without physical signatures.
21. CHOICE OF LAW
Enforced exclusively under Indian law. Courts at Dibrugarh, Assam possess exclusive jurisdiction.
22. AUTHORITY AND REPRESENTATIONS
Each Party represents and warrants full legal capacity, corporate authority, and compliance with applicable statutory regulations.
